Delivery Partner Terms and Conditions

Introduction

Welcome to the Chop Chop platform. These Delivery Partner Terms and Conditions (“Terms”) govern your participation as a delivery partner (“Delivery Partner”, “you”, or “your”) on the Chop Chop platform, a service that connects restaurants with customers to facilitate food delivery. By registering as a Delivery Partner on our platform, you agree to these Terms, which outline your obligations, payment terms, insurance requirements, and other essential aspects of our service.

1.  Registration as a Delivery Partner

  • Eligibility Requirements: To register as a Delivery Partner with Chop Chop, you must:
    • Be at least 18 years of
    • Possess a valid driver’s license and have legal authorization to work in the jurisdiction where you intend to deliver.
    • Own or have legal access to a delivery vehicle (bike, car, scooter, ) in good operating condition.
    • Pass a background check covering criminal history and driving
  • Account Setup: Complete the registration process by providing accurate and up-to-date personal information, vehicle information, and any required documentation.

2.  Payment and Delivery Operations

  • Acceptance of Deliveries: You have the discretion to accept or decline delivery However, once a delivery is accepted, you commit to completing it in accordance with Chop Chop’s standards and within the specified timeframe.
  • Payment Process: As a Delivery Partner, you will be paid directly by the restaurants for deliveries completed through the Chop Chop Payment will be facilitated by Chop Chop using its payment processing system.
  • Payment Timing: Payments will be processed and transferred to your bank account upon successful completion of a delivery and after the confirmation of order fulfillment to the customer’s satisfaction.
  • Deductions: The payment received by you will be net of any applicable payment gateway These fees are associated with the transaction processing services required to transfer funds from the restaurant to your bank account.
  • Payment Gateway Fees: The specific amount or percentage of the payment gateway fees will be disclosed to you at the outset of your registration with Chop Chop and may be subject to change. Notification of any changes to payment gateway fees will be provided to you in advance.
  • Payment Discrepancies: In case of any discrepancies or disputes regarding payment, Delivery Partners are encouraged to contact Chop Chop customer service promptly for resolution. Chop Chop is committed to ensuring fair and timely payment for all deliveries made through our platform.
  • Payment Information: You are responsible for providing accurate bank account details and ensuring that your information is up-to-date to avoid any payment delays. Chop Chop is not responsible for payments made to incorrect bank accounts due to outdated or incorrect information provided by the Delivery Partner.
  • Cost of Failed Delivery: As part of your responsibilities as a Delivery Partner with Chop Chop, it’s important to understand the implications of a failed delivery. A delivery attempt is considered failed if it is due to reasons attributable to the Delivery Partner’s actions or inactions, such as not following delivery instructions, refusal to deliver, or inability to deliver within the agreed timeframe without valid reason.
    • Bearing Costs: In the event of a failed delivery attributable to the Delivery Partner, you will be responsible for bearing the cost associated with the failed delivery attempt. This may include, but is not limited to, the cost of the food order if it cannot be returned to the restaurant, additional delivery fees, and any compensation to the customer as deemed appropriate by Chop Chop in accordance with our customer satisfaction policy.
    • Deductions: Any costs associated with a failed delivery will be deducted from your pending payments or, if necessary, billed directly to you for immediate payment. Chop Chop will provide a detailed breakdown of any charges incurred due to failed deliveries to ensure transparency.
  • Prevention and Mitigation: Delivery Partners are encouraged to communicate actively with both the restaurant and the customer in the event of any issues that may prevent a successful delivery. Chop Chop provides support and resources to assist Delivery Partners in navigating challenges and minimizing the risk of failed deliveries.

3.  Insurance and Liability

  • Vehicle Liability Insurance: As a Delivery Partner, you are required to maintain your own vehicle liability insurance, meeting the minimum requirements as per the laws of the jurisdiction in which you operate. Proof of such insurance must be provided upon registration and periodically upon request.
  • Indemnification: You agree to indemnify and hold harmless Chop Chop, its affiliates, and its and their officers, directors, employees, and agents, as well as any restaurants you deliver for, from any and all claims, demands, losses, liabilities, and expenses (including attorneys’ fees) arising out of or in connection with:
    • Your use of the Chop Chop platform and its
    • Your breach or violation of any of these
    • Chop Chop’s use of your
    • Any claim including but not limited to those in relation to your delivery services, vehicle operation, or any other actions or omissions by you.
  • Accidents and Incidents: In the event of an accident or incident involving your vehicle while making a delivery, you are responsible for reporting the incident to your insurance provider and to Chop Chop as soon as reasonably possible.

4.  Delivery Partner Obligations

  • Professional Conduct: You agree to conduct yourself professionally, treat customers respectfully, and deliver orders in a timely and safe manner.
  • Compliance with Laws: You must comply with all applicable laws, rules, and regulations, including traffic laws and food handling safety guidelines, while performing delivery services.

5.  Modifications to Terms

We reserve the right to modify these Terms at any time. Any changes will become effective immediately upon posting to the Chop Chop platform or as otherwise communicated to you. Your continued use of the platform following such changes will constitute your acceptance of the new Terms.

6.  Governing Law

These Legal Terms and your use of the Services are governed by and construed in accordance with the laws of the State of California applicable to agreements made and to be entirely performed within the State of California, without regard to its conflict of law principles.

7.  Termination

Either you or Chop Chop may terminate this agreement at any time, with or without cause, with notice to the other party as provided in these Terms.

By registering as a Delivery Partner on the Chop Chop platform, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
